This Policy constitutes the legal framework governing the relationship between the user, whether a shipper, carrier, driver, or visitor, and Across MENA, the owner and operator of the Camion application. By accessing or using the Camion application or website, you acknowledge and agree to be bound by this Policy and its terms, and you assume full legal responsibility for any use that violates this Policy or the applicable laws and regulations.

1. Introduction

This Policy outlines the types of personal data we collect, how such data is used and shared, and the options available to users regarding their data.

2. Overview

  • 2.1 Scope and Application: This Policy applies to all users of Camion services, including shippers, carriers or drivers, and any person interacting with the application in any capacity.
  • Shipper: Any individual or legal entity that owns, sends, or receives goods and requests transportation services.
  • Carrier / Driver: Any individual or entity providing trucking or transportation services.
  • User: Any person interacting with the application in any capacity. All of the above are collectively referred to as Users.
  • 2.2 Data Controller and Protection: Across MENA acts as the data controller responsible for processing personal data. We protect user data through encryption of data in transit and at rest, staff training on privacy and data protection, restricted internal access based on authorization levels, and limiting disclosure to governmental authorities unless legally required.

3. Data Collection and Use

  • 3.1 Data Provided by Users: This includes account information such as name, email address, phone number, and payment details, as well as identification documents and driver’s licenses, vehicle and insurance information, demographic data, and user-generated content such as photos, recordings, ratings, and communications.
  • Data Generated During Use: This includes location data, whether precise or approximate via mobile devices, shipment data such as load details, delivery information, and distances, usage data, device data such as device type and operating system, and communication data including calls and messages.
  • Data from Other Sources: We may receive data from other users or business partners, regulatory authorities, marketing service providers, integrated third-party applications, and publicly available sources.
  • 3.2 How We Use Data: Personal data is used for operating and managing transportation and logistics services, processing payments and invoicing, enhancing security and preventing fraud, communicating with users and sending notifications, complying with legal and regulatory obligations, and improving user experience and ongoing platform development.

4. Data Sharing and Disclosure

  • 4.1 Data Sharing: Data is shared strictly on a need-to-know basis with parties necessary to deliver services, including shippers and carriers for shipment execution, electronic payment providers, insurance companies, and government authorities upon formal legal request. We do not sell or lease personal data to any third party.
  • 4.2 Data Retention: Data is retained for the duration of the user relationship or as required by applicable laws. It may be deleted or anonymized once it is no longer needed. Users may request account deletion, subject to legal obligations.

5. User Rights and Controls

  • User Rights: Users have the right to access their personal data, request a copy of their data, correct or update their data, request deletion of their data, and restrict or object to data processing.
  • Controls and Permissions: Users may manage application permissions through their device settings and opt out of marketing communications.

6. Terms of Use

  • 6.1 Nature of the Platform: Camion operates as a digital intermediary platform connecting shippers and carriers. It does not act as a transportation provider nor as a contractual party to shipping agreements. The Company shall not be liable for service execution or for damages, losses, or delays resulting from direct interactions between users.
  • 6.2 User Eligibility: Users must be at least 18 years of age. Users registering on behalf of a company must have legal authority. Users previously suspended or banned may not re-register.
  • 6.3 Accuracy of Information: Users must provide accurate, complete, and up-to-date information and are solely responsible for any false or misleading data.
  • 6.4 Fees and Commissions: Application usage is free. A commission is charged on successful transactions, and payments are managed according to agreed arrangements between parties.
  • 6.5 Cancellation and Default: Compensation may be claimed if a shipment is cancelled after acceptance. If a truck has already reached the loading site, the shipper bears part of the agreed cost.
  • 6.6 Legal Compliance: Carriers must hold all required licenses and permits. Shippers must not transport prohibited or illegal goods. Each party bears full responsibility for the legality of shipments.
  • 6.7 Off-Platform Transactions: Users are prohibited from completing transactions outside the platform that were initiated within it, in order to prevent commission evasion and legal circumvention.
  • 6.8 Account and Security: Users are responsible for maintaining the confidentiality of their login credentials. Regular password updates are strongly recommended.
  • 6.9 Termination Rights: Camion reserves the right to suspend or terminate any account without prior notice in cases of misuse, fraud, or violation of laws or terms.
  • 6.10 Limitation of Liability: The application is provided on an as-is basis. The Company does not guarantee uninterrupted service and shall not be liable for indirect losses, technical failures, or misuse of the platform.

7. Confidentiality and Non-Disclosure

All operational data, reports, and business information related to Camion are considered confidential and proprietary. Users are strictly prohibited from copying, distributing, or sharing such information with unauthorized or competing parties.

8. Legal Compliance

This Policy is governed by the laws of the Syrian Arab Republic, including Law No. 3 of 2014 on Electronic Transactions, the Cybercrime Law, and any subsequent legislation related to data protection or e-commerce. Any misuse of the platform may result in legal prosecution.

9. Dispute Resolution

Disputes shall first be resolved amicably. Failing settlement, jurisdiction shall lie exclusively with the courts of Latakia, Syria. In disputes between users, Camion acts solely as a non-binding mediator.

10. Policy Updates

We may update this Policy from time to time. Continued use of the services constitutes acceptance of any updates.
